LP PHOTOGRAPHY

TERMS & CONDITIONS

These Terms & Conditions apply to all photography services provided by LP Photography (“LP Photography”, “we”, “us” or “our”). By making a booking with LP Photography, the client (“you” or “the client”) confirms that they have read, understood and agreed to these Terms & Conditions.

1. BOOKINGS

1.1 A booking is considered confirmed once LP Photography has received the required booking fee/deposit and the booking has been confirmed by LP Photography.1.2 Your booking is not guaranteed until the required booking fee has been received.1.3 By making a booking, you confirm that the information you have provided to LP Photography is accurate and complete.1.4 LP Photography reserves the right to decline a booking where appropriate

.2. BOOKING FEE & PAYMENT

2.1 A booking fee/deposit is required to secure your chosen date and time.2.2 The booking fee is non-refundable, except where LP Photography is unable to provide the agreed service and an alternative arrangement cannot reasonably be made.2.3 The remaining balance must be paid by the date agreed at the time of booking.2.4 LP Photography reserves the right to withhold photography services, image delivery or products where an outstanding balance remains unpaid.2.5 For weddings and larger events, payment arrangements and deadlines may differ and will be confirmed in writing at the time of booking.2.6 No date will be considered secured until the required booking fee has been received

.3. CANCELLATIONS

3.1 If you cancel your booking, your booking fee/deposit will not be refunded.3.2 Where possible, LP Photography may offer an alternative date, subject to availability.3.3 If a booking is cancelled after the booking fee has been paid but before the photography session takes place, any further balance already paid will be considered in accordance with the circumstances of the cancellation and applicable consumer rights.3.4 For weddings and larger events, cancellation arrangements may be subject to the specific agreement made at the time of booking.

4. RESCHEDULING

4.1 LP Photography will make reasonable efforts to accommodate requests to change the date or time of a booking.4.2 Rescheduled sessions are subject to availability.4.3 Where a client repeatedly requests changes to a booking, LP Photography reserves the right to treat the booking as cancelled.4.4 Any additional costs resulting from a requested change may be discussed and agreed with the client before the change is made.

5. PHOTOGRAPHY SESSIONS

5.1 Clients should arrive on time for their agreed photography session.5.2 If a client arrives late, the session may need to be shortened to avoid affecting other bookings.5.3 LP Photography will make reasonable efforts to capture the photographs discussed with the client but cannot guarantee specific poses, expressions, weather conditions, locations or photographs.5.4 The photographer may make creative decisions regarding composition, posing, lighting and editing in order to produce the best possible images.5.5 For children and family sessions, parents/guardians remain responsible for the supervision and safety of children at all times.

6. WEDDINGS & EVENTS

6.1 Wedding and event photography packages will be agreed with the client before the booking is confirmed.6.2 LP Photography will make reasonable efforts to follow the agreed photography schedule. However, delays caused by venues, guests, suppliers, weather, traffic or other circumstances outside the photographer's control may affect the schedule.6.3 The client is responsible for communicating any important photography requirements, timings, group photographs or specific requests to LP Photography in advance.6.4 LP Photography cannot guarantee that every requested photograph will be captured where circumstances, timings, venue restrictions or events outside the photographer's control make this impossible.6.5 Where a second photographer or additional photographer is included, this will be confirmed separately.

7. WEATHER & OUTDOOR SESSIONS

7.1 For outdoor photography, LP Photography may recommend changing the date where weather conditions are unsuitable or unsafe.7.2 The final decision regarding whether a session can safely proceed will be made in consultation with the client.7.3 Where an outdoor session is rearranged due to unsuitable weather, LP Photography will endeavour to offer an alternative date.7.4 LP Photography is not responsible for weather conditions that affect the appearance, location or outcome of an outdoor session.

8. CLIENT RESPONSIBILITIES

8.1 Clients are responsible for providing accurate information regarding the booking.8.2 Clients should inform LP Photography of any relevant requirements or restrictions that may affect the photography session.8.3 Clients are responsible for ensuring that they have any necessary permissions to be photographed or to arrange photography at a particular venue or location.8.4 Where photographs include children, the parent or legal guardian is responsible for providing the necessary consent.

9. IMAGE SELECTION & EDITING

9.1 LP Photography will select and edit photographs at its professional discretion unless a different arrangement has been agreed in writing.9.2 Editing may include adjustments to exposure, colour, contrast, cropping, sharpness and other artistic adjustments.9.3 Extensive retouching or bespoke editing may incur an additional charge where agreed in advance.9.4 RAW/unprocessed files are not supplied to clients unless specifically agreed in writing.9.5 LP Photography's editing style forms part of the service provided. Clients are encouraged to review LP Photography's portfolio before booking to ensure they are happy with the photographic and editing style.

10. IMAGE DELIVERY

10.1 Finished photographs will normally be supplied digitally through an online gallery or another agreed method.10.2 Delivery times will vary depending on the type and size of booking. An estimated delivery timeframe will be provided where appropriate.10.3 LP Photography will make reasonable efforts to deliver photographs within the agreed timeframe but cannot guarantee a specific delivery date unless this has been expressly agreed in writing.10.4 Clients are responsible for downloading and safely storing their photographs once they have been delivered.10.5 LP Photography cannot guarantee permanent storage of galleries or photographs and clients should keep their own backup copies.

11. COPYRIGHT

11.1 Copyright in all photographs remains the property of LP Photography unless otherwise agreed in writing.11.2 Clients receive a personal-use licence to use the supplied photographs for their own personal purposes.11.3 Clients may share photographs on personal social media accounts, provided that the images are not materially altered and LP Photography is credited where reasonably possible.11.4 Photographs may not be sold, commercially licensed, substantially altered, edited or used for commercial purposes without written permission from LP Photography.11.5 Businesses, organisations and other commercial clients must obtain written permission before using photographs for advertising, marketing or other commercial purposes unless commercial usage has been included within their package.

12. SOCIAL MEDIA & PROMOTIONAL USE

12.1 LP Photography may use photographs taken during a session for its website, portfolio, social media, advertising and other promotional purposes.12.2 By booking with LP Photography, you consent to this promotional use unless you specifically opt out.12.3 Clients who do not wish their photographs to be used for promotional purposes should notify LP Photography at the time of booking or before the photography session takes place.12.4 LP Photography will respect a client's decision to opt out of promotional use.12.5 LP Photography will not knowingly identify children by their full name when using photographs for promotional purposes unless specific permission has been provided.

13. PRINTS & PRODUCTS

13.1 Where prints, wall art, gifts or other photographic products are ordered, the client is responsible for checking any details provided for the order.13.2 Once a bespoke or personalised product has been ordered, cancellations or changes may not be possible.13.3 Product delivery times may vary depending on the supplier.13.4 LP Photography will make reasonable efforts to resolve any problems with photographic products supplied to the client.

14. LOSS, DAMAGE & CIRCUMSTANCES BEYOND OUR CONTROL

14.1 LP Photography will take reasonable care to protect and preserve photographs.14.2 In the unlikely event that photographs are lost, corrupted or damaged due to technical failure, equipment failure, memory card failure or another circumstance beyond LP Photography's reasonable control, LP Photography's liability will be limited to the amount paid for the affected photography service, subject to applicable law.14.3 LP Photography will make reasonable efforts to maintain backup copies of photographs during the editing and delivery process but cannot guarantee permanent storage.14.4 LP Photography will not be responsible for circumstances outside its reasonable control, including but not limited to severe weather, illness, accidents, venue closures, travel disruption, government restrictions or other emergencies.14.5 Where LP Photography is unable to attend a booking due to illness, emergency or another serious circumstance, we will make reasonable efforts to arrange a suitable replacement photographer or alternative date where possible.14.6 If LP Photography is unable to provide the service and no reasonable alternative can be arranged, any payments made for services that cannot be provided will be dealt with in accordance with applicable UK consumer law.

15. PRIVACY & PERSONAL INFORMATION

15.1 LP Photography will collect and process personal information necessary to provide its services, communicate with clients, process bookings and payments, and fulfil orders.15.2 Personal information will be handled in accordance with applicable UK data protection and privacy legislation.15.3 LP Photography will not sell clients' personal information to third parties.15.4 Information may be shared with trusted suppliers where necessary to fulfil an order or provide a service, for example photographic printing or product suppliers.

16. COMPLAINTS

16.1 LP Photography wants every client to be happy with their experience.16.2 If you have a concern or complaint, please contact LP Photography as soon as reasonably possible so that we have the opportunity to investigate and resolve the matter.16.3 Complaints should preferably be made in writing so that the details can be properly considered.16.4 LP Photography will aim to respond to complaints within a reasonable timeframe.

17. LIMITATION OF LIABILITY

17.1 Nothing in these Terms & Conditions excludes or limits any liability that cannot legally be excluded or limited under UK law.17.2 LP Photography will take reasonable care when providing photography services.17.3 Subject to applicable law, LP Photography will not be liable for indirect or consequential losses arising from circumstances outside its reasonable control.

18. CLIENT SATISFACTION

18.1 LP Photography aims to provide photographs that reflect its established creative style.18.2 By booking LP Photography, clients acknowledge that photography is a creative service and that the final images may vary from their personal expectations.18.3 Clients are encouraged to discuss important requirements, preferences and must-have photographs before or during the session.

19. CHANGES TO THESE TERMS

19.1 LP Photography reserves the right to update these Terms & Conditions from time to time.19.2 The Terms & Conditions applicable to a booking will normally be those in place at the time the booking is made.19.3 Any significant changes affecting future bookings will be communicated where appropriate.

20. GOVERNING LAW

20.1 These Terms & Conditions are governed by the laws of England and Wales.20.2 Any disputes will be dealt with in accordance with applicable UK law and consumer protection legislation.
